Unauthorized reproduction, reverse engineering, derivation of source code, or unauthorized use of the protected technology may constitute infringement of applicable intellectual property laws. All rights not expressly granted are reserved.

4. Notice to Third Parties

The patent-pending designation described in this notice applies to technology incorporated within Dermi products. The filing of the patent application establishes a documented filing date for the described inventions. No enforceable patent rights arise unless and until a patent is granted; upon grant, reasonable compensation may be available in respect of the period after the application is open to public inspection, in accordance with section 55(2) of the Patent Act (Canada).

Dermi reserves the right to enforce its intellectual property rights to the fullest extent permitted by applicable law, including seeking injunctive relief and damages for any unauthorized use, reproduction, or misappropriation of the protected technology.

6. Governing Law

This notice and any disputes arising from or relating to the intellectual property described herein shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Proceedings related to this notice are intended to be brought before the courts located in Toronto, Ontario.
