Dermi Atlas Cloud Demo Disclaimer

BY ACCESSING THE DERMI ATLAS CLOUD DEMO ("DEMO"), YOU AGREE TO THE FOLLOWING TERMS, IN ADDITION TO THE DERMI TERMS OF SERVICE.

The Dermi Atlas Cloud Demo may be accessed through the Dermi Portal or, optionally, through the Dermi Atlas Companion iOS application. All restrictions in this Disclaimer apply equally regardless of the access method, and each Cloud Demo session requires affirmative acceptance of this Disclaimer.

1. STRICTLY NO HEALTH INFORMATION / REAL PATIENT DATA

WARNING: The Dermi Atlas Cloud Demo environment is a sandbox environment. It is not designed to meet the specific security safeguards required for the storage of sensitive Health Information under the Health Insurance Portability and Accountability Act (HIPAA), the Personal Information Protection and Electronic Documents Act (PIPEDA), or the Privacy Act 1988 (Cth).

You strictly agree NOT to upload, enter, or transmit any real Health Information. For the purposes of this Disclaimer, "Health Information" includes:

• Protected Health Information (PHI) as defined by HIPAA (U.S.);
• Personal Health Information as defined by applicable Canadian legislation (e.g., PHIPA, HIA, or the Act Respecting the Protection of Personal Information in the Private Sector in Quebec); and
• Sensitive information (including health information) as defined by the Privacy Act 1988 (Cth) and applicable Australian state and territory health records legislation.

Requirements:

• Use Dummy Data Only.
• Liability: You are solely liable for any privacy breaches, regulatory fines, or legal action resulting from your upload of real patient data to the Demo environment.

2. Evaluation Only & Prohibited Actions

The Dermi Atlas Cloud Demo is for evaluation only. You may not:

• Use the Demo for production, clinical, or diagnostic purposes.
• Perform penetration testing, load testing, or vulnerability scanning on the Demo environment.

3. Data Wiping

NO DATA PERSISTENCE: Patient records, entries, images, and clinical metadata uploaded to the Dermi Atlas Cloud Demo are purged on a regular schedule (no less frequently than once per week) and may also be wiped without notice for maintenance or operational reasons. Account credentials, user preferences, and acceptance logs are preserved separately. Any clinical data you enter into the Demo will be permanently deleted without notice.

4. No Warranty

The Demo is provided "AS IS." Dermi Inc. assumes no liability for uptime, performance, or data loss.

5. Governing Law

This Disclaimer is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and is subject to the dispute resolution provisions of the Dermi Terms of Service.
